OF GARISTON
CHAPTER
1 – THE TYRANNY
Part A –
The Nation
1. The State
The Armed Tyrannic Republic of Gariston is a sovereign micronation established by the tyrant
president Nick Papias for the common good of its people.
2. The Constitution
This Constitution is the supreme law of the Tyrannic Republic and all the laws are subject
to it.
3. Symbols of the Republic
a. The
Republic have a flag, a coat of arms and a national anthem.
b. The use of national symbols is regulated by law.
Language
4. Language
There are 4 official languages of the GaristianRepublic: Greek, English, French and Garistian. But all three are spoken with a Garistian accent with various endings.
Part B –
The People
5. Persons in the Republic
a. The
right of a person to enter and to remain in the Republic shall be in accordance with international and the garistian law.
6. Citizenship
a. Citizenship
is not open to anyone.
b. A person
becomes a citizen when he lives legally in the country for 20 years, has a legal job and obeys the laws of Garistian Republic.
c. Garistian
citizens believe in the true values of nation, race and family. So, no homosexuals,
anarchists, drug and alcohol involved people and can be garistian citizens. Only
people from the countries where people started set out on the quest for Gariston and people with a strong desire to live in
the 1970’s are allowed to apply for citizenship. Exception to that rule is the city of Ektrom, where all the people are black and, of course, the indigenous people of the country.
7. Rights
a. Human
life is sacred and shall be protected by the government. Human Rights are in
harmony with the laws.
b. All persons
in the Republic are entitled to:
i. The right to life and physical integrity.
ii. The right to family life, privacy and property. Personal life is well protected
and respected by the State.
iii. Freedom of legal religious belief and association, assembly, and speech including
written expression. The recognized religions in Gariston, are Christianity (in
any form), Judaism and Paganism. No satanic and black magic cults are allowed
in Gariston.
iv. The right to education and cultural development. Every person has the right
to receive education.
v. The right to work. Full employment is the government’s priority.
vi. Citizens of Gariston are completely equals before the law. Due process of justice
includes a fair hearing before a court of jurisprudence, the right to legal representation and the right to request a trial
by a jury of his peers, except for the drug dealers and child, aged and animal abusers and rapists, who will be banished immediately.
vii. represent themselves as garistian citizens and show its national symbols.
viii. outside Gariston
Republic, enjoys the protection of its diplomatic and consular organs
and officials.
ix. vote in the elections and be a
candidate, unless his candidacy is restricted by another article of the present Constitution.
CHAPTER
2 – LAWMAKING
PART A – ELECTIONS
8. Elections take place every 4 years. In
the election procedure participate all legal political parties, recognized by the Supreme Court of the Armed Tyrannic Republic
of Gariston. The electoral system permits the first in votes political party
to be the legal government of the State.
9. The
election day is Saturday which is the official holiday of Gariston, (as much as Sunday).
10. The candidates
of the parties must be:
i. Legal Citizens of Gariston,
ii. Never convicted for criminal acts,
iii. Never convicted of treason against the Republic.
iv. Not subject to any drug, alcohol or sexually abnormal passion.
PART B - The
Legislative Power
11. Legislative Power
The legislative power of the Republic belongs to the Tyranny Council in accordance
to the parliament and subject to this Constitution.
12. Enactment of a Law
A law of the Republic is enacted when it is approved by the President and the
government of the Republic.
CHAPTER
3 – THE EXECUTIVE
Part A –
The Executive Power
13. Executive Power
The executive power of the Republic is vested in the Tyranny Council, which
is subject to this Constitution and shall carry into action the executable powers of government under law.
14. Ministers
a. The
Tyranny Council may appoint Ministers for the administration, supervision and development of civil service departments and
policy portfolios in the Republic.
b. A person
becomes a Minister when he is –
i. a legal citizen of the Republic,
ii. never convicted of any criminal
act,
iii. a devoted patriot,
c. The
appointment by the Tyranny Council of a Minister for certain duties implies the delegation by the Tyranny Council to that
Minister of all executive powers necessary for the fulfillment of those duties.
15. Allegiance Declaration
A person appointed as a Minister shall make official declaration in the
following form: “I affirm my allegiance to the Tyrannic Republic of Gariston
and to the national and racial ideals and aspiration of the Constitution of the Republic, and declare my commitment to serve
the Republic faithfully and to the best of my ability in my mission”.
Part
B –The TYRANNY Council
16. Appointment
a. A
Tyranny Council consisting of five members elected by the President of the Republic.
17. Duties and Powers of the Executive Council
a. The
Tyranny Council must exercise its executive power for the achievement of the ideals expressed in the introduction of this
Constitution.
b. The Council
is under obligation of duty to –
i. delegate its executive power and make executive and judicial appointments only
in such manner as is consistent with lawful government,
ii. promptly undertake any action or duty required by this Constitution; and
iii. represent the Republic honestly in international relations, dealings and treaties.
c. The
Council is empowered as specified elsewhere in this Constitution and also –
i. to appoint judges,
ii. to appoint Ambassadors, which power may not be delegated,
iii. to appoint other diplomatic representatives,
iv. to appoint the commanding officer of the Defense Forces of the Republic, and
issue operational and other orders to that commanding officer, which powers may not be delegated,
v. to commission other officers in the Defense Forces.
18. The President
a. The
President is the head of the State and his power is undisputable.
b. If the
President is absent from the Republic or has any kind of problem, the Prime Minister shall act in his stead.
c. If
the Tyranny Council consists of only one member, that person is the President of the Republic.
CHAPTER
4 – JUDICIARY AND COURTS
19. The Judicial Power
The judicial power of the Republic vests in such courts as are created by law in accordance with this Chapter
of the Constitution.
20. Creation and Jurisdiction of Courts
a. Courts
may be established by law for any practical purpose of the judicial power of the Republic.
b. A law
to create a court shall specify the jurisdiction of the court. For this purpose, it shall be lawful to vest a court with all
jurisdiction not already vested in another court.
c. A
law to create a court shall specify the number of judges required to exercise the jurisdiction of that court.
21. Appellate Jurisdiction
a. No
court may hear an appeal from any court, including itself, unless it is vested with the jurisdiction to hear such an appeal.
b. In the
absence of any other provision, the Tyranny Council may exercise appellate jurisdiction from any court in the Republic.
c. Any
court vested with appellate jurisdiction is also vested with the power of discretion as to whether or not to hear an appeal
submitted to it.
22. Appointment of
Judges
a. A
judge shall be appointed to a court by the Tyranny Council if and when a matter is brought before that court, and that judge
shall hold tenure only for the duration required to dispose of that matter.
b. A person
is qualified to be a judge if he is capable of fulfilling that role, and he is –
i. a citizen of the Republic,
ii. not a member of the Tyranny Council,
iii. not a person who has been convicted of any criminal offence,
iv. not a person who at any time has been convicted of treason against the Republic,
v. a person of good character.
vi. a person who is not submitted to any drug, alcohol or sexually abnormal passion.
c. The
tenure of a judge shall be terminated if he resigns, or is appointed to another court, or becomes ineligible under paragraph
(b) above.
23. Allegiance Declaration
Upon appointment to a judicial office, a judge or judicial
officer shall declare in the following form: “I hereby affirm my allegiance to the Republic of Gariston and to the national
ideals and aspirations of the Constitution of the Republic and declare my commitment to serve the Republic faithfully and
to the best of my ability as a judicial officer”.
CHAPTER
6 – PERPETUAL LIFE AND BANISHMENT CLAUSES
24. All citizens of the Republic shall be entitled to enjoy perpetual life in accordance with the
forces that rule the land and have the right to live in one specific period of
history which has been decided to be the period of the 1970’s as it was on the continent of Europe.
25. The period in which the citizens live may not change without a vote by the absolute majority
of the congress, which is defined to be at least 90% of the elected representatives and the agreement of the President and
the Prime-Minister.
26. The highest penalty of the land shall be reserved
only for the most heinous of crimes and high treason. This penalty shall be banishment from the land. As time stands still
in Gariston, banished people will be subject to the ravages of time by living outside the borders of the Republic and so will
become mere mortals. It is understood that for elderly people this may very well mean immediate death as their bodies will
turn to dust as soon as they leave the Republic.
CHAPTER
7 – AMENDMENT OF THE CONSTITUTION
27. Amendment by Referendum
This Constitution shall not be amended except with the approval of two-thirds of the citizens of the Republic,
voting in a referendum. An amendment approved in this manner becomes effective at the moment the referendum result is published.
28.
Amendment Proposals
A proposal for amendment of this Constitution will be put to a referendum
when it satisfies the following requirements:
a. The
proposal must be approved by the President and the Tyranny Council.
b. If the
proposal to amend the Constitution is not in its entirety, then the proposal shall be only for one substantive matter.
c. The
proposal must be submitted to the Tyrant President of the Republic.
29. Conduct of a Referendum
a. a
referendum shall not be held within the period 20 days before or 30 days after a general election,
b. the electoral
roll of citizens entitled to vote in the referendum shall be closed when the proposal is published by the President,
c. a
citizen who is under sentence for a criminal offence under the laws of the Republic may not vote in the referendum, and that
citizen shall not be counted in calculation of the two-thirds majority,
d. the referendum
shall be a secret ballot, and voting shall remain open for not less than three days regardless of whether or not a definitive
result is known before that time,
e. the
result of the referendum shall be published by the President without delay after the end of voting.
CHAPTER
8 –ENACTMENT
30. Enactment
a. This
Constitution is enacted when it is approved by not less than 50% of the citizens of the Republic at a referendum held for
that purpose.
b. The validity
of the enactment of this Constitution is not susceptible to judicial review
